Terms of Service

These Terms of Service ("Terms") form a public offer under Articles 633, 641 and 642 of the Civil Code of Ukraine. They set out how maryan4ik.dev ("Provider") delivers services to any individual or company ("Client"). Acceptance is written approval of the scope in a messenger or e-mail, signing a contract or invoice, or making a prepayment.

Development and support of websites, online stores, mobile apps (iOS, Android), web systems, CRM, admin panels, Telegram bots and Mini Apps; branding; SMM, video shooting and editing, Stories; setup and management of ads, including Google Ads. Scope, stages, deadlines and price are fixed in a contract, invoice or specification agreed by both parties.

1) The Client describes the task, the Provider runs a brief and sends an offer. 2) The parties agree the specification and price, the Client pays the prepayment. 3) The Provider works in stages and shares interim results. 4) The Client sends feedback or approves a stage within 3 business days. No reply within 5 business days counts as acceptance. 5) After final payment, the Provider hands over the result and access.

Prices on the site are indicative ("from"). The final price is set in the contract. Typical scheme: 50% prepayment, the rest after the approved result. Large projects may be paid in stages. Subscription services (SMM, support) are paid monthly in advance. Payment methods and terms are in the "Payment" tab.

Provide materials (texts, logos, photos, access) on time; approve stages and pay promptly; confirm that they hold rights to the materials they supply. Delays by the Client extend deadlines accordingly.

The price includes an agreed number of revision rounds (2 per stage by default). Changes beyond the specification are estimated separately and done after the extra cost and time are agreed.

After full payment, property rights to the result created for the Client (design, source code, content) pass to the Client under the Law of Ukraine "On Copyright and Related Rights". Moral rights stay with the author. The Provider may show the work in a portfolio unless agreed otherwise. Third-party libraries, fonts and services are used under their licenses.

The Provider fixes defects caused by its fault free of charge during the warranty period stated in the package or contract. The warranty does not cover outages of third-party services, hosting, payment systems or ad platforms, nor changes made by third parties.

The Provider's liability is limited to the amount paid for the relevant stage. The Provider does not guarantee specific commercial results (leads, sales, search rankings) as they depend on the market, budget and the Client's actions. Neither party is liable for force majeure (Article 617 of the Civil Code), including hostilities and power or network outages.

The parties do not disclose each other's commercial information without written consent. Personal data processing is described in the Privacy Policy.

Either party may terminate by written notice. Refunds are described in the Refund Policy. Disputes are settled by negotiation and, failing that, in court under the laws of Ukraine.

The Provider may update the Terms. The new version applies from its publication on the site and does not change agreed contracts.
